By creating an account, accessing, or using Breche (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using Breche on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree, do not use the Service.
Breche is a cloud-based construction management platform operated by La Breche Co LLC. The Service includes tools for managing contacts, leads, projects, estimates, proposals, invoices, expenses, work orders, service contracts, time tracking, scheduling, dispatch, document management, and a client portal for sharing documents with your clients.

All plans include every feature. There are no add-ons or hidden fees.
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be suspended, but your data will be retained for 30 days to allow you to subscribe and resume.
Breche allows you to share proposals, invoices, contracts, and other documents with your clients through a secure portal accessible via unique token links. You are responsible for:

We make reasonable efforts to maintain the availability and performance of Breche. However, the Service is provided without a guaranteed uptime SLA. We may experience downtime for maintenance, updates, or unforeseen issues. Where possible, we will provide advance notice of planned maintenance.
The Breche name, logo, software, design, and documentation are the intellectual property of La Breche Co LLC. You may not copy, modify, distribute, or create derivative works of our software or branding without written permission. Your content and data remain your property as described in Section 6.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRECHE AND LA BRECHE CO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Breche is a business management tool. It is not a substitute for professional legal, financial, accounting, engineering, or construction advice. You are responsible for ensuring your use of the Service complies with all applicable laws, codes, and regulations in your jurisdiction.
You agree to indemnify, defend, and hold harmless La Breche Co LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall first be addressed through informal negotiation by contacting us at info@breche.us. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or in a court of competent jurisdiction in the State of New Jersey. Claims eligible for small claims court may be filed there instead.
We may update these Terms from time to time. When we make material changes, we will provide at least 30 days’ notice by updating the “Effective” date at the top of this page and, where appropriate, notifying you via email. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.
